Things to keep in mind:

  • The court sets how far above one year's pay the amount goes; the tool only calculates from the months you enter.
  • Proof of the union reason (burden of proof, art. 25/6) and the invalidity of the dismissal are not assessed.
  • Interest, tax deductions and severance/notice pay may be due separately; they are not included.

About this tool

Article 25 of the Trade Unions and Collective Labour Agreement Act (No. 6356) prohibits dismissing or treating employees differently because they join or do not join a union or take part in union activity. If the employer breaches these rules, union compensation of not less than the employee's one year's pay is awarded (art. 25/4).

Formulas

  • Union compensation = Monthly pay × Months awarded (≥ 12)
  • Minimum = Monthly pay × 12

Example: monthly pay TRY 25,000.55 and the court awards 15.5 months: compensation TRY 387,508.53; the statutory minimum is TRY 300,006.60.

If the contract is terminated for union reasons the employee may sue under arts. 20 and 21 of the Labour Act; once union-based termination is established, union compensation is awarded whether or not the employee is reinstated. If the employer does not reinstate, no separate art. 21/1 failure-to-reinstate compensation is awarded (art. 25/5).

Example 2: With monthly pay of TRY 40,000 and the statutory minimum of 12 months awarded, union compensation is TRY 480,000.00; this equals the statutory minimum.

How to read the result: "Union compensation" is the monthly pay multiplied by the months you entered. "Statutory minimum" shows the 12-month (one-year) amount at the same pay; compensation cannot be lower. If the union compensation is set above this minimum, the excess is at the court's discretion. Amounts are gross; interest, tax deductions and separate claims such as severance and notice pay are not included. Proof of the union reason and the invalidity of the dismissal are not assessed; the result is a calculation based on the assumptions you enter.

How to use

  1. Enter the monthly gross pay (with regular benefits).
  2. Enter the months awarded or claimed (at least 12).
  3. Press Calculate.

Notes

Amounts are rounded HALF_UP to two decimals. Gross amounts are calculated; tax and stamp deductions are excluded. Months may be fractional.
