Things to keep in mind:
- Employees who resign without observing their notice period may be liable to pay notice compensation to the employer.
- Notice pay is not applicable during statutory probation or in cases of summary dismissal for just cause under Articles 24 and 25 of the Labour Law.
- No statutory cap applies to notice pay in Turkey; it is calculated on the full dressed gross wage.

About this tool
Under Article 17 of Turkish Labour Law No. 4857, prior notice is required before terminating an indefinite-term employment contract. The party that fails to give statutory notice must pay notice compensation (notice pay) in lieu of the notice period.
Statutory Notice Periods (Labour Law Art. 17)
- Less than 6 months tenure: 2 weeks (14 days)
- 6 to 18 months tenure: 4 weeks (28 days)
- 18 to 36 months tenure: 6 weeks (42 days)
- More than 36 months tenure: 8 weeks (56 days)
Tax & Deduction Rules
- SGK (Social Security): Exempt from employee and employer social security premiums.
- Income Tax: Notice pay is treated as wage income and taxed at the progressive income tax rate (15%, 20%, 27%, 35% or 40%).
- Stamp Duty: Subject to a 0.759% stamp duty deduction.
